  1. Nueva orden ejecutiva número OE-2022-0014 del 20 de febrero de 2022.

 

 

Basado en nuestra consulta al Departamento de la Vivienda sobre la aplicabilidad de la nueva orden ejecutiva número OE-2022-0014 al Proyecto FACILITIES REMODEL AND IMPROVEMENT WORKS FOR RESILIENCY AND NEW ESTABISHMENT OF HOGAR DE AYUDA EL REFUGIO, INC., queremos informar que luego de analizada la respuesta se ha determinado que para efectos del proceso No.: RFP- 2021-DR-0195-DBS-3 la orden ejecutiva número OE-2022-0014 NO tendra aplicabilidad sobre el proyecto y proceso ya lanzado el pasado 10 de enero de 2022. Por lo que el proyecto continuará siendo regido bajo la orden ejecutiva anterior.  

 

Debido a esta aclaración la fecha límite para la entrega de propuestas continuará hasta mañana 4 de marzo del 2022 tal y como establece el “RFP Schedule” table.

1. Consulta sobre nueva orden ejecutiva número OE-2022-0014 del 20 de febrero de 2022.

 
El pasado 20 de febrero de 2021, el Gobernador de Puerto Rico, Hon. Pedro Pierluisi Urrutia firmó, con vigencia inmediata, la orden ejecutiva número OE-2022-0014. Esta Orden Ejecutiva fija un salario mínimo a empleados diestros de $15.00/hora y a los no diestros de $11/hora.  
 
Las definiciones de cuales posiciones en proyectos de construcción para los contratistas y subcontratistas y/o sobre quiénes deben considerarse ser un obrero diestro o no diestro serán provistas por el Secretario del Trabajo en los próximos días. Por lo que todo proponente debe estar muy atento a ello y calificar y adjudicar esos nuevos salarios. 
 
La nueva orden ejecutiva número OE-2022-0014 que aplicará a empleados de todo proyecto de construcción financiado total o parcialmente con fondos federales otorgados para la reconstrucción o recuperación de Puerto Rico y que sean contratados por el Gobierno de Puerto Rico, sus agencias, instrumentalidades y corporaciones públicas. No aplica a proyectos contratados por los municipios.  
 
Estamos consultando al Departamento de la Vivienda si el Proyecto del proceso RFP- 2021-DR-0195-DBS-3 FACILITIES REMODEL AND IMPROVEMENT WORKS FOR RESILIENCY AND NEW ESTABISHMENT OF HOGAR DE AYUDA EL REFUGIO, INC. tiene que ser regido bajo la nueva orden ejecutiva número OE-2022-0014 o no, ya que se entiende que la orden ejecutiva establece que su aplicación será prospectiva, por lo que los contratos ya firmados y los procesos para la contratación comenzados o publicados antes de su aprobación, incluyendo sus enmiendas, no estarán sujetos a esta orden ejecutiva.  
 
Por lo que necesitamos antes de continuar con un proceso profesional y correcto consultar al Departamento de la Vivienda si en el caso del proceso RFP- 2021-DR-0195-DBS-3 FACILITIES REMODEL AND IMPROVEMENT WORKS FOR RESILIENCY AND NEW ESTABISHMENT OF HOGAR DE AYUDA EL REFUGIO, INC. desde antes de la orden ejecutiva número OE-2022-0014 se mantiene bajo la antigua orden ejecutiva OE-2021-0231, donde se requiere un salario mínimo en proyectos de construcción financiados total o parcialmente con fondos federales a $10.95. 
 
Debido a la situación causada por la Rama Ejecutiva estamos posponiendo la entrega de propuestas hasta el viernes 4 de marzo del 2022 para poder obtener confirmación del Departamento Legal de CDBG-DR del Departamento de la Vivienda al respecto y que puedan establecer en sus costos los salarios que se rijan a base de las instrucciones que se reciban por el Departamento de la Vivienda de Puerto Rico.

  1. For project cost breakdown purposes, please inform if HARI is exempt from the payment of Patent and Construction Taxes. This item is a considerable amount. It is important to know if we include it in the cost of the project.
 
Construction Xperts ANSWER:
 
In the present the non-profit organization, Hogar de Ayuda El Refugio, Inc. (HARI) is not exempt by law from complying with payments of construction patents and payments of construction taxes to the municipality of Cataño. 
 
Regulatory liability for the payment of construction taxes is a requirement and responsibility of the developer or owner of any construction project in any municipality. In the case of the project HARI where a "Design-Build" service will be contracted, the proposer must contemplate the costs and payment of taxes as part of their proposal and cost.
 
 
Second Jobsite Visit
 
Responding to the requests of various proponents to visit the Ramon B. Lopez School, we have planned a second jobsite visit. So that, we can guarantee the same opportunity to everyone.

  • SECTION 1.1 QUALIFICATIONS

1.1 Qualifications

Proposer(s) that complies with all mandatory requirements will be evaluated on their qualification’s requirements. The HOGAR DE AYUDA EL REFUGIO, INC.  reserves its right to request additional information to address minor irregularities and minor instances of non-compliance. Qualification requirements will have a total maximum score of 138 points.

 

1.1.1 Capacity to Provide Services: Proposers shall provide the following information with their responses. This part of the Proposer’s Qualifications will have a maximum score of 26 points.

  • Profile. Provide a company profile and, if applicable, If the entity responding to this RFP was recently created, the profile shall set forth the overall experience of each of the members within the company. 20 points for “Outstanding Performance Profile”; 10 points for “Medium Performance Profile”; 5 points for “Low Performance Profile”. (20 points)

  • Identification. The Proposer’s and, if applicable, Team Members and/or First-Tier Subcontractor’s Tax-ID, Data Universal Numbering System (DUNS) Number, and year of establishment. Proposers shall provide all the information requested as part of Exhibit B (Statement of Qualifications). Form of Business. The Proposer’s and, if applicable, Team Members and/or First-Tier Subcontractor’s form of business (e.g., corporation, non-profit corporation, limited liability company, professional services company) and detail the names, telephone numbers and email addresses of its officers, directors, members and any partners, if applicable, as well as the persons the HOGAR DE AYUDA EL REFUGIO, INC.  should contact regarding the Proposal. Proposers shall provide the information requested herein as part of Exhibit B (Statement of Qualifications). (2 points)

  • Organizational Chart. An Organizational Chart for the services. 
    The Proposer’s shall include an organizational chart information. (2 points)

  • Integrity. Has the Proposer or any of its Team Members and/or First-Tier Subcontractor, if applies been involved in any criminal, civil, or administrative suits, actions, investigations, litigations, sanctions and/or administrative complaints or proceedings that where commenced, pending, settled, threatened, resolved, or concluded during the five-year period prior to the date of the Proposal Due Date? If the answer to this question is “yes”, state for each such suit, action, investigation or proceeding the (a) date of the suit, action, investigation or proceeding (or time period involved); (b) the specific nature of the suit, action, investigation or proceeding; (c) the amount of funds involved, if any; (d) the names of the parties; (e) the names and complete addresses of the courts and law enforcements agencies involved; (f) the title and file number of the suit, action, investigation or proceeding; (g) the disposition or current status; and (h) any sentence, fine or other penalty imposed. Also include an opinion from an attorney discussing whether the services will be impacted by the litigation. Proposers shall provide the information requested herein as part of Exhibit B (Statement of Qualifications). (1 points)

  • Current contract/projects. Provide a list of ongoing contracts/projects and projected completion dates. Also, include the level of effort in such projects of the Key Staff proposed for the services. The Proposer’s ongoing contracts/projects will be evaluated for their potential to affect the provision of the services requested. If the Proposer is composed of various entities (e.g. a Joint Venture), then ongoing contracts/projects shall be provided for all entities. Proposer shall provide the information requested herein as part of Exhibit B(Statement of Qualifications). (1 points)

 

 

1.1.2 Comparable Projects: This part of the Proposer’s Qualifications will have a maximum score of 20 points

Proposer must provide a list of at least five (5) comparable projects, current or within the last ten (10) years, where the Proposer or any of its Team Members provided the combination of Design-Build services that include but are not limited to construction services as Prime Contractor, demolition and/or abatement services, architectural and engineering (A/E) design services, and which qualify the Proposer(s) to manage the Design-Build Service component of the SIH Program. Projects submitted should preferably be for single, two-unit structures, Group Homes- or multi-family designs. Projects submitted as part of this list must have had an estimated construction cost greater than or equal to one million dollars $1,000,000. These Projects, and their data, will be provided by the Proposer in  (). 

 

Team Member and/or First Tier Subcontractors comparable projects may be considered as part of the evaluation of the Proposer’s comparable projects evaluation. In order to consider Team Member and/or First Tier Subcontractors comparable projects.

 

The Proposer must provide documentation within the Proposal demonstrating the relationship between the Proposer and any of its Team Members and/or First Tier Subcontractor/s to allow the  to verify and combine the collected experiences. The evaluation of this section will be done taking in consideration the submitted information regarding the relationship and qualifications of Team Members and/or First Tier Subcontractor/s, if provided.

 

1.1.3 Continuous Business Establishment, Operation Time, List of Clients, Reputation and Managerial, Organization, and Technical Capabilities:This part of the Proposer’s Qualifications will have a maximum score of 32 points.

 

For Key Staff as related to the engagement the Proposer must provide résumés including the name of resources to be assigned, education, copy of licenses and certifications, years of experience, including start and end dates for each job position (s) and project (s). The Proposer must fill the pertinent Key Staff member’s information as part of Exhibit B (Statement of Qualifications). Refer to Exhibit A-1 (Scope of Work) for detailed requirements and roles of each Key Staff. Key Staff that will be required as part of the responses to this RFP include the following: 

Total Corporation or Entities Established dates evidence. Proposer must provide the Department of State Registration year of the Corporation. Proposer will receive 1 point per year up to 10 years of continuing operation.   (10pts)

Company partners and owners’ reputation. Provide corporation partners involvement in the construction industry and leadership acknowledge (5pts)

Complex Projects Experiences. Please provide corporation partners and owners’ experience in complex projects. (5pts)

Permitting Experience. Please provide corporation partners and owners’ experience with permitting. (5pts)

American Disability Act (ADA) Experience. Please provide corporation partners and owners’ experience with the American Disability Act (ADA). (1pts)

Project Demolition and Site Work experience. Please provide corporation partners and owners’ experience with permitting Project Demolition and Site Work experience.  (5pts)

Project Projected Team Members Resumes. (1pts)

 

  • SECTION 1.2 WORK APPROACH

 

1.2 Work Approach

Each Proposer shall draft and submit a Work Approach document as part of the Proposal. The Work Approach will have a total maximum score of 14 points. The document shall clearly state the following:

 

1.2.1 A brief description of the Proposer’s overall understanding of the goals and requirements of the SIH Program. (2 Points)

1.2.2A brief approach to the Proposer’s general administration and coordination of the Design-Build Services efforts under an engagement with the HOGAR DE AYUDA EL REFUGIO, INC.  (2 Points)

1.2.3 A brief description of the Proposer’s general experience and knowledge of local standards of design and construction requirements in Puerto Rico. Provide a description as to how the Proposer will ensure efficient integration of the design and construction components of the Project. (2 Points)

1.2.4 A brief approach as to how the Proposer will ensure all local, state, and federal permit requirements applicable to the SIH projects are met. (2 Points)

1.2.5 A brief approach and plan to ensure quality of, demolition, abatement, and construction design-build works. (2 Points)

1.2.6 A brief approach as to how the Proposer will ensure that, demolition, abatement, repair, and construction design-build works are provided within established Program cost caps and within schedules for performance. (2 Points)

1.2.7 A brief approach as to how the Proposer will ensure that applicant complaints and warranty issues are properly managed and resolved. (2 Points)

The Work Approach responses shall not exceed seven (7) pages. Responses that exceed the page limit will only be evaluated up to the contents of page 7. Content beyond this point will not be considered in the evaluation.

 

  • SECTION 1.3 SUGGESTED DESIGN SUBMISSION

 

Suggested Design Submissions will be evaluated based on the following criteria (8 points):

  • Budged Maximization: Proposed design concepts data will be evaluated for their overall budget maximization methods of construction proposed. Will be important to demonstrate how many housing units can ben achieve. (2 Points)

  • Resiliency: Proposed design concepts data will be evaluated for their availability to provide more resiliency to the Subrecipient.  (2 Points)

  • Impact of vulnerable people: Proposed design concepts data will be evaluated for the overall impact on vulnerable people that the Subrecipient serves. (2 Points)

  • Independent Disability Living: Proposed design concepts will be evaluated for their offer in disable independent housing units living spaces Exhibit A-1 (Scope of Work). (2 Points)

 

  • SECTION 4 PROPOSAL EVALUATION 

 

1.3 Evaluation

The HOGAR DE AYUDA EL REFUGIO, INC.  will conduct a comprehensive, fair, and impartial evaluation of Proposals received in response to this RFP.

 

Following the submittal of Proposals, the evaluators will meet to evaluate each Proposal based on the criteria stated in this RFP. Initial evaluation will consider the Mandatory Requirements of the Proposal stated in Section 6.1 of this RFP. Those Proposer’s whose Proposals meet the Mandatory Requirements will be evaluated for Qualification and Work Approach requirements. A score to each evaluation criteria will be assigned by the evaluators. To be considered “Qualified Proposers”, Proposers need to obtain a score greater than or equal to 100 points in the evaluation of their Qualifications, Work Approach and Conceptual Design Submittal.

 

1.4 Proposal Scoring

Table 2  presents the maximum points for the Mandatory, Technical Requirements and Cost Proposal requirements. For details regarding the distribution of each technical aspect of the Proposal refer to the corresponding section. Table 2 also considers the Preference of 5 points for Section 3 Business Concern and/or MWBE Business.

1. Can you sent us the As-Built plans in DWG format?

 

Construction Xperts ANSWER: 

 

No. Only PDF format drawings were provided to assure that all proposers have equality of conditions. There are software and platforms that converts PDF drawings into DWG format drawings, therefore it is the proposer’s sole responsible of any conversion of these drawings in any other format than the original PDF format provided as part of the RFP.

 

The other reason we will not provide any CAD format files, is due to the fact that all companies have different versions of Autocad or any other CAD software and many times provided CAD files are not compatible with all proposer’s software and that may place a proposer in disadvantage with another proposer and that cannot happen.

 

For these reasons, proposer must use at its discretion and without limitation the provided PDF as built drawings.

 

 

2. If Pre-Bid Site Visit and Virtual Meeting were not required, can any other company participate in this  RFP?

 

Construction Xperts ANSWER:  

 

Yes. The Puerto Rico Department of Housing Grant Managers for the SIH Program under CDBG-DR indicated us to eliminate mandatory Pre-Bid, Mandatory Site visits and Virtual Meetings from an RFP Process in order to have greater participation of Proposers in the RFP.

 

It is encouraging to participate in these events, because it will give a better knowledge of the RFP and the project processes and requirements. However, it is not mandatory.

 

Therefore, a proposer that didn't assist or participate in any of these events can submit a RFP Proposal package. 

 

3. Is mandatory to submit or provide a Conceptual Design as part of the RFP?

 

Construction Xperts ANSWER:

 

As indicates in the RFP documents a proposal with Conceptual Design is not mandatory. If a proposer doesn't provide it, the proposer just doesn't obtain Points for it in that section. Conceptual Design submittal is a suggested item in this RFP.

 

If a proposer doesn't provide it, the proposer will not be disqualify from the RFP because it is not part of the Mandatory Requirements section.
